These Terms and Conditions ("Terms") govern your use of the website hmfoodtrailer.com (the "Site") and any products, quotes, custom orders, or services offered by HM Food Trailers ("HM Food Trailers," "we," "us," or "our"), a business located at 2400 Austin Hwy, San Antonio, TX 78218.

By accessing the Site, requesting a quote, placing an order, or otherwise engaging our services, you ("you," "customer," or "buyer") agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Overview of Services

HM Food Trailers designs, builds, customizes, and sells food trailers and related equipment, and may facilitate access to third-party financing options. We also offer "ready to go" pre-built units and other related services as described on the Site.

2. Quotes and Orders

2.1 Quotes Are Not Binding Offers

Quotes provided through our online form, by phone, email, or in person are estimates based on the information you provide (size, materials, equipment, features) and are subject to change based on final specifications, material costs, and availability at the time of order confirmation.

2.2 Order Confirmation

An order is only confirmed once (a) you and HM Food Trailers agree on final specifications and price, (b) a signed order form or written agreement is executed, and (c) the required deposit (see Section 3) has been received.

2.3 Custom Builds

Custom trailers are built to the specifications agreed upon at the time of order. Changes requested after production has begun may result in additional costs and/or delays, which will be communicated to you before being applied.

3. Pricing, Deposits, and Payment

3.1 Pricing

All prices are quoted in U.S. Dollars (USD) and do not include applicable state or local sales tax, title/registration fees, or delivery charges unless expressly stated.

3.2 Deposits

Custom orders are paid in three installments:

30% of the total order price at the time the order is placed, to begin production;
30% at the midpoint of the agreed build timeline; and
the remaining 40% upon delivery.

All installments are due on the schedule above unless otherwise agreed in writing. Amounts already paid are subject to the cancellation and refund terms in Section 3.3.

3.3 Cancellations and Refunds

Cancellations requested within two (2) calendar days of order confirmation are eligible for a full (100%) refund of amounts paid.
Cancellations requested after day two (2) and through day seven (7) following order confirmation are eligible for a 50% refund of amounts paid, because materials and labor are committed based on your specific order.
Cancellations requested after day seven (7) are not eligible for a refund, except as required by applicable law.
Refunds, when applicable, will be processed within thirty (30) days of the cancellation request.

3.4 Financing

HM Food Trailers may connect customers with third-party lenders (banks, SBA lenders, equipment financing companies, or private lenders) for financing purposes. HM Food Trailers is not a lender and does not guarantee approval, rates, or terms offered by any third-party financing provider. All financing agreements are strictly between you and the financing provider, and are subject to that provider's own terms, credit checks, and disclosures.

4. Build Timeline and Delivery

4.1 Estimated Timelines

Build timelines communicated to you are estimates only and may vary due to factors including material availability, custom specifications, permitting, weather, or other circumstances beyond our reasonable control.

4.2 Delivery

We offer nationwide delivery. Delivery timeframes, costs, and logistics will be confirmed at the time of order. Risk of loss or damage to the trailer transfers to the customer upon delivery/acceptance, unless otherwise agreed in writing.

4.3 Delays

HM Food Trailers is not liable for delays caused by events beyond our reasonable control (force majeure), including but not limited to supply chain disruptions, natural disasters, or third-party delivery/carrier delays.

5. Health Code, Permits, and Compliance

Food trailers are built with general commercial kitchen standards in mind; however, it is the customer's sole responsibility to verify and obtain any permits, licenses, inspections, or approvals required by their local, state, or municipal health department, fire marshal, or other regulatory authority in the jurisdiction where the trailer will operate. Requirements vary significantly by city and state, and HM Food Trailers makes no guarantee that a trailer will automatically pass inspection in every jurisdiction.

6. Warranties and Disclaimers

6.1 Limited Warranty

The limited warranty that applies to your trailer — including what it covers and how long it lasts — is set forth in the written order form or purchase agreement signed for your build. That signed document governs the warranty for your order and should be read together with the exclusions in Section 6.2 below. If you have not received a copy of your signed agreement, contact us using the information in Section 13.

6.2 Exclusions

This warranty does not cover: normal wear and tear; damage caused by misuse, neglect, improper maintenance, or unauthorized modifications; damage from accidents, weather events, or transportation after delivery; third-party equipment or appliances not manufactured by HM Food Trailers (which may carry their own manufacturer warranties).

6.3 Disclaimer

EXCEPT AS EXPRESSLY STATED IN THIS SECTION AND IN YOUR SIGNED ORDER FORM OR PURCHASE AGREEMENT, THE TRAILER AND ANY RELATED SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HM FOOD TRAILERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR PURCHASE OR USE OF A TRAILER OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ORDER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO HM FOOD TRAILERS FOR THE TRAILER OR SERVICE GIVING RISE TO THE CLAIM.

Some states do not allow certain limitations of liability, so some of the above limitations may not apply to you.

8. Reviews and Testimonials

Reviews, ratings, and testimonials displayed on the Site (including any aggregate rating such as "4.9/5.0") reflect the genuine experiences of customers to the best of our knowledge and are sourced from Google Reviews and Facebook Reviews. We do not fabricate or materially alter customer reviews.

9. Intellectual Property

All content on the Site — including text, images, logos, graphics, and design — is the property of HM Food Trailers or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written consent.

10. Website Use

You agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to the Site or its systems
Submit false or misleading information through our quote forms
Interfere with the proper functioning of the Site

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms, your order, or your use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in Bexar County, Texas, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
